CDL DUI in Virginia and the 0.04 BAC Limit
A commercial driver in Virginia is held to half the alcohol limit that applies to other drivers. The general DUI statute, Va. Code § 18.2-266, uses a blood alcohol concentration of 0.08%. Under the Virginia Commercial Driver’s License Act, which begins at Va. Code § 46.2-341.1, CDL holders are subject to a 0.04% threshold and stricter disqualification rules. The consequence that matters most to a working driver is in Va. Code § 46.2-341.18. A first major offense, which includes DUI at 0.04 or more and refusal of a test, brings a 1-year disqualification from operating a commercial vehicle. The period is 3 years when hazardous materials are involved. A second major offense brings a lifetime disqualification. For a driver whose income depends on the license, the disqualification can outweigh the court penalty. To discuss a CDL-related charge with Law Offices Of SRIS, P.C., call (888) 437-7747.

Why refusal does not protect a CDL
Some drivers believe that refusing a test avoids the 0.04 problem. The statute closes that door. Refusal is listed as a major offense in § 46.2-341.18, next to DUI at 0.04 or more. Virginia’s implied consent law, Va. Code § 18.2-268.3, also penalizes an unreasonable refusal on its own: a first refusal is a civil violation with a 1-year license suspension.
How Mr. Sris and the Firm’s Of Counsel Attorneys Handle CDL DUI Charges
A CDL case is handled as two problems at once: the charge in court and the disqualification that follows a conviction. The stop, the testing procedure, and the result are reviewed against the statute that was charged. The driver’s record is checked for earlier major offenses and for serious traffic violations within 3 years, because those entries change the disqualification period. The client receives a plain explanation of what each possible outcome would mean for the commercial license before any decision is made.
